Terms of Service

1. Who we are

Fithab is developed and operated by Ruben Tiso, an individual developer based in Switzerland. Contact: ruben.tiso@gmail.com.

2. The service

Fithab is a fitness and habit tracking app. It lets you record body weight, calories and nutrition, workouts, step count and daily habits, track streaks and XP, and receive AI-generated coaching suggestions. Heart rate tracking is planned for a future release. Features may change, be added or be removed as the app develops.

3. Accounts

• You must be at least 16 years old to create an account.
• You are responsible for keeping your login credentials confidential and for activity that happens under your account.
• You must provide accurate information and keep your email address up to date.
• You may delete your account at any time from within the app.

4. Health disclaimer

Fithab is not a medical device and does not provide medical advice, diagnosis or treatment. Workout plans, calorie and macro targets, and AI coach replies are informational only and may be inaccurate or unsuitable for you. Consult a qualified physician or dietitian before starting any exercise or nutrition programme, especially if you are pregnant, have an injury, an eating disorder, or any medical condition. Stop exercising and seek medical help if you feel unwell. You use the app and follow its suggestions at your own risk.

5. Acceptable use

You agree not to:

• Use the app for any unlawful purpose or in breach of these terms.
• Attempt to access other users' accounts or data, or bypass security or usage limits.
• Reverse engineer, scrape, overload or interfere with the app, its servers or its APIs.
• Upload content that is illegal, abusive, harassing, hateful, or that infringes the rights of others.
• Impersonate another person or misuse the friends, challenge or messaging features.

We may suspend or terminate accounts that breach these rules, with notice where reasonably possible.

6. Your content

You keep ownership of the data and content you enter into the app. You grant us a limited licence to store, process and display that content solely to operate the app for you — for example to sync your workouts across devices and generate coaching replies. We do not sell your content. See the Privacy Policy for details.

7. Subscriptions and payments

• Fithab offers a free tier with usage limits and an optional paid premium subscription ($3.99/month at the time of writing). Prices, billing periods and included features are shown before you purchase.
• Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, invoicing, cancellation and refund mechanics for direct purchases are governed by the Paddle Checkout Buyer Terms.
• Subscriptions renew automatically until cancelled. You can cancel at any time in the app or via paddle.net; access continues until the end of the paid period.
• We offer a 30-day money-back guarantee — see our Refund Policy. Statutory withdrawal and refund rights also apply. Purchases made through the Google Play Store or Apple App Store are subject to that store's refund policy.

8. Third-party services

The app relies on third-party services for authentication and hosting, AI model responses, public food database lookups and payment processing. Their availability and accuracy are outside our control, and their own terms may apply to their part of the service.

9. Availability

We aim to keep Fithab available and reliable but do not guarantee uninterrupted or error-free operation. Maintenance, updates or issues at our providers may cause downtime. We may modify or discontinue features at any time.

10. Liability

To the extent permitted by law, Fithab is provided "as is" without warranties of any kind. We are not liable for indirect or consequential damages, loss of data, lost profits, or for injury or health consequences arising from your use of the app or reliance on its suggestions. Nothing in these terms limits liability for intentional misconduct, gross negligence, or any liability that cannot be excluded under Swiss law.

11. Termination

You may stop using Fithab and delete your account at any time. We may terminate or suspend access if you materially breach these terms or if we discontinue the service. On termination your data is deleted as described in the Privacy Policy.

12. Changes to these terms

We may update these terms as the app evolves. Material changes will be announced in the app before they take effect. Continuing to use Fithab after changes take effect means you accept the updated terms.

13. Governing law

These terms are governed by Swiss law, without prejudice to mandatory consumer protection rules of your country of residence. The courts of Switzerland have jurisdiction, subject to those same consumer rules.
